Overwatch Data, Inc.
Terms of Use
These terms govern your use of overwatchdata.ai and related Overwatch websites (the "Site"). Access to the Overwatch platform is governed by a separate services agreement between Overwatch and your organization.
Acceptance
By accessing or using the Site you agree to these Terms of Use and to our Privacy Policy. If you do not agree, do not use the Site. If you use the Site on behalf of an organization, you represent that you have authority to bind it.
Eligibility and use
The Site is intended for business and professional use by persons 18 or older. You may use the Site for lawful purposes and in accordance with these terms. We may suspend or terminate access at any time for conduct we believe violates these terms or is harmful to Overwatch, other users, or third parties.
Intellectual property
The Site and its content, including text, graphics, logos, images, software, and the Overwatch name and marks, are owned by Overwatch Data, Inc. or its licensors and are protected by copyright, trademark, and other laws. Except as expressly permitted, you may not copy, modify, distribute, republish, or create derivative works from Site content without our prior written consent. Third-party names and logos appearing on the Site belong to their respective owners and are used to identify their products or services.
Acceptable use
You agree not to: access the Site by automated means, including scraping, crawling, or harvesting, except as permitted by our robots.txt; attempt to probe, scan, or test the vulnerability of the Site or circumvent any security or access controls; interfere with the Site's operation or impose an unreasonable load on its infrastructure; impersonate any person or misrepresent your affiliation; submit false or misleading information through our forms; or use the Site to transmit malware or unlawful content.
The Overwatch platform
Access to the Overwatch platform, including any trial or demonstration environment, is provided under a separate written agreement between Overwatch and the customer organization. That agreement governs use of the platform and any data or intelligence delivered through it. Nothing on the Site grants a license to the platform. The free threat assessment offered on the Site is governed by the Free Threat Assessment Terms below.
Free Threat Assessment Terms
These terms apply when you request a free threat assessment from Overwatch Data, Inc. ("Overwatch") through our website. By checking the box on the request form, you agree to them on behalf of the organization you name.
- Who can request one. You must make the request on behalf of a business, public body or other organization, with authority to agree to these terms for it. Overwatch reviews each request and may decline or limit any assessment.
- What you give us. Your organization's domains and, if you choose, its card BINs. Only submit assets your organization owns or is authorized to have assessed.
- What we do. We search sources Overwatch can lawfully access, such as the open web, criminal forums, marketplaces and messaging channels, for information about the assets you submit. We don't connect to your systems, ask for credentials or install software, and we don't test or attack your infrastructure.
- What you receive. A written summary of what we found, sent to the email address on the request, usually within 5 business days. Findings reflect what we could see at the time, and we may not find every exposure. Sensitive data in the findings, such as credentials or card numbers, is masked.
- Confidentiality. We treat your submission and the results as confidential and use them only to prepare the assessment and to discuss it, and Overwatch's services, with you. The results are for your organization's internal use.
- Third parties. If we find an active threat to someone outside your organization, such as a card issuer, we may tell them about the threat without naming you.
- Retention. We delete the domains and BINs you submit 90 days after we receive them. We keep your contact details, and the record that you accepted these terms, as described in our Privacy Policy.
- No charge, no obligation. The assessment is free and creates no obligation to buy anything.
- No warranty. The assessment and results are provided "as is", for information only. They are not legal, security or other professional advice, and you decide what action to take.
- Liability. To the extent the law allows, Overwatch's total liability arising from the assessment is limited to one hundred U.S. dollars (US$100), and Overwatch is not liable for indirect or consequential losses.
- Other terms. These terms sit alongside our Terms of Use and Privacy Policy; if they conflict, these terms govern the assessment. Delaware law applies, as in the Terms of Use. We may update these terms, and the version in force when you submitted your request applies to it.
Site content
Content on the Site, including statistics, case examples, and product descriptions, is provided for general informational purposes. Product features and figures may change without notice. Illustrative data shown in interface mockups and feed panels is representative and does not depict any specific customer or incident. Nothing on the Site constitutes legal, security, or professional advice.

The Site may link to third-party websites. We do not control them and are not responsible for their content, policies, or practices. Links do not imply endorsement.
Disclaimers
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION. OVERWATCH DOES NOT WARRANT THAT THE SITE WILL BE ERROR-FREE OR FREE OF HARMFUL COMPONENTS.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, OVERWATCH AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE. OVERWATCH'S TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE JURISDICTIONS OUR LIABILITY IS LIMITED TO THE EXTENT PERMITTED BY LAW.
Indemnification
You agree to defend, indemnify, and hold harmless Overwatch and its affiliates from claims, damages, and expenses, including reasonable attorneys' fees, arising from your violation of these terms or your misuse of the Site.
Governing law and disputes
These terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Any dispute arising from these terms or the Site will be brought exclusively in the state or federal courts located in New Castle County, Delaware, and you consent to their jurisdiction. If any provision is found unenforceable, the remainder will continue in effect. These terms, together with the Privacy Policy, are the entire agreement between you and Overwatch regarding the Site.
Changes
We may revise these terms at any time by posting the updated version here with a new date. Continued use of the Site after changes are posted constitutes acceptance.
